Except the Republican-controlled Senate will either not approve anyone nominated by Obama, or will tie up the nomination process so long that it will end up being passed over to the next Administration.  That's what happened when Earl Warren stepped down and Johnson nominated Abe Fortas -- and the Repubs weren't even in the majority, they just filibustered his nomination aggressively (backed by Dixiecrats).  And they tied things up long enough that ensured the nomination would be made by the next president... who turned out to be Richard Nixon.
